HB 194 in 2013 enacted the comptroller to "adopt rules to provide goals for increasing the contract awards for the purchase of goods or services by the commission and other state agencies to businesses that qualify as historically underutilized businesses because the businesses are owned or owned, operated, and controlled, as applicable, wholly or partly by one or more veterans as defined by 38 U.S.C. Section 101(2) who have a service-connected disability as defined by 38 U.S.C. Section 101(16). The goals established under this subsection are in addition to the goals established under Subsection (c) and the goals established under Subsection (c) may not be reduced as a result of the establishment of goals under this subsection."

The Veteran Entrepreneur Program (VEP), established in 2013 per Texas Code Sec. 434.022. (2)(c), provides veteran entrepreneurs and veteran small businesses the tools they need to start or grow their businesses.


RULE §20.306 states:

  "Goods produced or offered by a Texas bidder that is owned by a service-disabled veteran who is a Texas resident shall be given a first preference and goods produced in this state or offered by other Texas bidders shall be given second preference, if the cost to the state and quality are equal; and a first preference shall be given to services offered by a Texas bidder that is owned by a service-disabled veteran who is a Texas resident and a second preference shall be given to services offered by other Texas bidders if:

(A) the services meet state requirements regarding the service to be performed and expected quality; and 
(B) the cost of the service does not exceed the cost of other similar services of similar expected quality that are offered by a bidder that is not entitled to a preference under this subsection."

Effective January 1, 2022, through December 31, 2025, you may again form a "new veteran-owned business" as defined by Senate Bill 938 (87th Reg., 2021). A new veteran-owned business is not subject to certain filing fees and the Texas franchise tax until the earlier of the fifth anniversary of the entity's existence or the date the business ceases to qualify as a new veteran-owned business.
